Welcome to Florida's Realty, LLC (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our websites, applications, content, tools, and real estate brokerage services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1) Who We Are

Florida's Realty, LLC provides residential real estate brokerage services throughout Southwest Florida, including property marketing and listing services, buyer and seller representation, market analysis, and transaction coordination. Certain features of the Services may be provided by third parties (e.g., IDX/MLS data providers, lenders, inspectors, title companies).

2) Not Legal, Tax, or Financial Advice

Information on the Services is provided for general informational purposes only and does not constitute legal, tax, financial, or insurance advice. You should consult appropriate professionals for advice tailored to your situation.

3) Eligibility & Acceptable Use

You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to misuse, interfere with, or attempt to gain unauthorized access to the Services; not to scrape, copy, or reproduce content except as permitted; and not to upload or transmit malicious code.

4) Accounts & Communications

To access some features you may need an account. You agree to provide accurate, current information and to keep your credentials confidential. By submitting your contact information, you consent to be contacted by phone, text, email, or other means regarding your inquiry. Message and data rates may apply. You may opt out as described in our communications.

5) IDX/MLS Data & Listing Information

Property data displayed through the Services may be provided via third‑party IDX/MLS feeds and is deemed reliable but not guaranteed. Listings may change without notice. You should verify information independently, including measurements, HOA/condo rules, flood zones, insurance requirements, and school assignments.

6) Commissions, Fees & Service Packages

Compensation, commission, and fee structures are defined in written listing, buyer‑broker, or referral agreements that you execute with us and may vary by property, service level, and market conditions. Any offers of compensation to cooperating brokers are set, if any, by the seller and/or listing agreement and may be changed at any time. Your financial obligations will be stated in your signed agreements.

7) Third‑Party Services & Links

We may provide referrals or links to third‑party providers (e.g., lenders, inspectors, insurance, title, movers). These are offered for convenience only; we do not control and are not responsible for third‑party products or services. Your dealings with third parties are solely between you and them.

8) Intellectual Property

The Services and all content (including text, graphics, logos, photos, and layouts) are owned by us or our licensors and are protected by law. You may not use our trademarks or copyrighted materials without prior written permission, except as otherwise permitted by law.

9) Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to our data practices as described there.

10) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, RELIABILITY, NON‑INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. Real estate transactions involve risks; you are responsible for performing due diligence.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FLORIDA'S REALTY, LLC OR ITS OWNERS, AGENTS, OR AFFILIATES BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY WILL NOT EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US FOR SERVICES IN THE SIX MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

12) Indemnification

You agree to defend, indemnify, and hold harmless Florida's Realty, LLC and its agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services or violation of these Terms.

13) Termination

We may suspend or terminate access to the Services at any time with or without notice for any reason, including violation of these Terms. Provisions that by their nature should survive termination shall survive (e.g., intellectual property, disclaimers, limitations of liability).

14) Governing Law & Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict‑of‑law principles. Exclusive venue for any dispute shall be the state courts located in Manatee County, Florida, or the U.S. District Court for the Middle District of Florida, as applicable.

15) Changes to the Terms

We may update these Terms from time to time. Changes become effective upon posting to the Services with a revised “Last updated” date. Your continued use following changes means you accept the updated Terms.

The property information herein is derived from various sources that may include, but not be limited to, county and state records and the Multiple Listing Service, and it may include approximations. Although the information is believed to be accurate, it is not warranted and you should not rely upon it without personal verification. Not intended as a solicitation if your property is already listed by another broker. Our real estate agents are independent contractor sales or broker associates, not employees. Florida's Realty, LLC and all of it's agents fully support the principles of the Fair Housing Act and the Equal Opportunity Act.
